The Department of Environment has advised FTMTA that they are aware of problems in relation to suppliers continuing to supply for agricultural use the higher sulphur grade of fuel which continues to be legitimately available for home heating use. All diesel supplied for use in agricultural tractors since March 31st, 2011 must meet the standards that are generally described as ultra low sulphur diesel (ULSD).
The Department has confirmed that the relevant statutory instrument makes it an offence for any oil supplier to place the old grade of fuel on the market for agricultural purposes and they are currently considering enforcement activity to ensure compliance.
Farmers and contractors should ensure that they are being supplied with the correct fuel and should make it clear to their suppliers that the fuel is required for agricultural use and that the supplier will be held liable for any issues arising from the supply of an incorrect fuel. All suppliers of fuel should be willing to specify the grade of fuel supplied on the delivery docket and invoice.
